San Antonio Police Chief William McManus testified Thursday he did not pressure three of his officers to accept a five-day suspension for the amount of force they used on the wrong man while pursuing a suspect nearly 10 years ago. “That has never been an MO of mine, coercing anyone,” McManus said during a trial for a civil lawsuit accusing the officers of using excessive force.

Mark Delgado, who supervised the SWAT unit at the time, testified later Thursday that he did not believe the officers violated policy but said he personally apologized at the scene to Carlos for being targeted by mistake. Officers going after the wrong person while looking for a suspect “happens a lot, actually,” Delgado said.
Man injured in mistaken police encounter files suit in federal court Despite McManus’ finding, lawyers hired by the city of San Antonio to defend the officers argued they did nothing wrong because the constitutional standard for finding them liable for excessive force is different from the standard for SAPD’s policy.
