to fill that seat. There seems to be little standing in the way of Republicans deciding to use that obstructionist tactic again. That means Democrats need to fill this seat now, before the midterm elections, if they have any hope of filling the seat at all.
Second, the Supreme Court decides many important cases that do not fall as predictably on ideological fault lines. The next person occupying Breyer’s seat could play a key role in those cases where the vote may be 5-4. On the campaign trail, Biden promised to pick a woman of color to fill a vacancy on the Supreme Court.
While Breyer’s retirement won't change the ideological balance on the court, it will result in someone with another set of life experiences sitting on the most powerful bench in the world. Justices are not computers. We don’t simply input a bunch of data and wait for them to spit out a legal decision. They are people whose worldview and past experiences inform their decisions.
76% of Americans want a Supreme Count Justice that is chosen for their merits & qualifications. Not by their gender or skin color. Anyone who is chosen by this standard will never be legitimately qualified to sit on the Supreme Court in the eyes of the American People.

Breyer made it clear last year that he had no intention of retiring. Biden and the Democrats made it clear he could retire or have a fatal accident. They made him an offer he couldn't refuse.
