In certain Democratic circles, there's a shared fantasy that Chief Justice John Roberts will refuse to toady to Trump at his impeachment trial. But this, writes ScottTurow, is highly unlikely to come true

The Senate rules are plain: “The Senate shall have power to compel the attendance of witnesses, to enforce obedience to its orders...to punish in a summary way contempts...and to make all lawful orders, rules, and regulations which it may deem essential or conducive to the ends of justice.” That would be bad news for Trump and the Republicans: The idea is preposterous, on its face, that the head of the executive branch can simply order whoever he wants not to participate in a congressional undertaking of such gravity. That would put the president in complete control of a proceeding designed to possibly remove him from office.

You can expect the House managers to engage in some political kabuki and ask Roberts to order Mulvaney or Bolton to show up. Or to order that he compel the White House to produce documents it has so far withheld. But Roberts’s answer, under the rules, is pretty clear: “Not my job.” The Senate Democrats can then demand that the full Senate vote on that ruling. But Roberts’s answer, again, is likely to be, “Sorry”—because the Senate, not Roberts, decides on witnesses.
