A former senior adviser to WA's Treasurer has been found not guilty of indecently assaulting a female colleague at a drunken Christmas function.Prosecutors claimed the woman told deliberate untruths and liesStephen Kaless, the former media adviser to Ben Wyatt, had been on trial for the past day and a halfThe incident was alleged to have happened on the evening of December 13 last year at a bar at Elizabeth Quay, where the partygoers had gone after having lunch at a West Perth restaurant.
The evidence in the case included CCTV footage from the bar, which Mr Kaless's lawyer Linda Black submitted "positively demonstrated" the alleged offence did not occur. Mr Dworcan submitted that a text message sent to her the next morning by Mr Kaless in which he apologised could be taken as an "implied admission"."Touching a female colleague is the kind of thing that even a very drunk person was likely to remember," he said.
She then urged the magistrate to make a finding that the woman had told "deliberate untruths" and "deliberate lies", describing her evidence as "most unsatisfactory". He said after the allegations surfaced, in the days after the party, he was "given no choice but to resign" from his job."That is a discussion for another day … my resignation and the issues surrounding it will be a matter for the WA Industrial Relations Commission," he said."The Department of Premier and Cabinet will certainly be having a discussion with the WA Industrial Relations Commission … to discuss the circumstances surrounding my resignation.
