The Constitutional Court has dismissed an application for leave to appeal the case involving Public Enterprises Minister Pravin Gordhan and Sars “rogue unit” report. The application was lodged by the EFF and Public Protector Busisiwe Mkhwebane last year

They were seeking to appeal an order by the Pretoria High Court that interdicted the Public Protector’s remedial action against Gordhan while he took her report on review.

“Once a report is published and made available for public consumption, it’s difficult to understand how an interim interdict against the enforcement of the remedial action hinders the effectiveness of the Public Protector. How would an interim interdict hinder her in the exercise of her powers, or prevent her from exercising her functions once the report is in the public domain?” asked Gordhan through his lawyer, Tebogo Malatji.

The court granted the interim interdict because the requirements for such an interdict were set out in a case involving the Organisation Undoing Tax Abuse – now called the Outa test. Both parties filed urgent applications for leave to appeal the judgment and orders in the Constitutional Court.
