EFF leader Julius Malema asked judge Elias Matojane, who ruled Jacob Zuma’s parole to be unlawful, how society would benefit if an 80-year-old man was incarcerated.

Matojane had last year ruled that Zuma should return to jail and the time he spent on medical parole should not be counted as part of his sentence. The former president was granted parole two months into his 15 months direct imprisonment sentence on contempt of court charges.

Matojane is one of the candidates being interviewed by the Judicial Service Commission as it searches for judges to fill vacancies in the superior courts. Malema asked him “hypothetically”: “Is it in the best interest to incarcerate old people who are not in line with what the correctional service system seeks to achieve?”

Crime does not pay simple

So if a 80 year old murders someone they shouldn’t be incarcerated? The law doesn’t care about your opinions or emotions. The law must be applied without fear or favour. Zuma needs to serve his entire sentence in a correctional facility just like everyone else.

The benefit to society is that all are equal before the law and the law knows no age, gender and status.

80+ year old Nazi bigwigs are still being pursued in Argentina 77 years after WW2 and prosecuted. Age is not an excuse to do state capture. What the EFF leader is doing by his remark is only to further affirm the president's guilt.

Julius Malema is a proxy of Jacob Zuma in that platform. The JSC will soon receive a complaint about his conduct. Once the court rules in favour of a complainant, it will be the end of him in that Commission.
