COLUMBUS, Ohio – An Ohio Senate committee passed bipartisan legislation Tuesday that creates a new criminal charge of using a device or app to track a person without their consent.

Sponsoring Sens. Nathan Manning, a North Ridgeville Republican, and Nickie Antonio, a Lakewood Democrat, said they drew inspiration for the bill fromshe believes a disgruntled boyfriend stuck to her car. Currently, surreptitiously tracking someone with a device like an AirTag “may not explicitly or unambiguously violate” current law,According to the Ohio Association of Prosecuting Attorneys, a federal survey of stalking victims indicates use of this technology-enabled stalking is on the rise.

The bill allows exceptions to the new rules for some law enforcement activity; parents or guardians tracking their children; caregivers tracking an elderly or disabled person they tend to; a non-private investigator acting in good faith on behalf of a “legitimate business purpose;” and private investigators on certain cases.
