Briana Rae Harris disputes the contention of the Rebelz Club in Centre County that its dancers are private contractors.

The lawsuit accuses the club and two owners/managers of violating the Fair Labor Standards Act and the Pennsylvania Wage Payment and Collection Law. The club set the fees for private dances and kept half of the amount. The dancers’ half plus their tips were combined at the end of the night. While a shift officially was 9 p.m. to 5 a.m., dancers were not permitted to leave until at least 6 a.m. to allow time to reconcile customer payments, tips and deductions. That is when dancers would be paid.

Besides seeking certification as a class action, the suit seeks unspecified compensatory and punitive damages.
