At 10:20 p.m. July 27, police were investigating drug complaints outside the LBJ Food Mart in the 13000 block of Jupiter Road when an officer said they saw 30-year-old Kyle Dail making"multiple hand-to-hand drug sales" in the parking lot.
The officer then followed Dail's vehicle and attempted to stop him for a traffic violation, police said. However, Dail did not stop and officers attempted to follow him but lost sight. At around 11:35 p.m., an officer saw Dail's car back at the gas station and called for other officers to take him into custody.
Minutes later, at 11:43 p.m., officers Thomas Hoffman, Noah Hemm, and Michael Piering of the northeast patrol unit entered the store—locating Dail facing the back wall.During their struggle, Dail pulled a handgun from his waistband and raised it in front of officer Hoffman's face, police said. Officer Hoffman then fired his weapon, striking Dail.
After reviewing surveillance cameras and officer body cameras, detectives saw Dail remove the handgun from his pocket. An officer can also be heard warning the other officers that Dail had a gun.Dail was unresponsive and taken to Presbyterian Hospital where he remains in critical condition, police said. No officers were injured and this remains an ongoing investigation.
