In a setback for the millions of Americans who have fallen behind on rent payments, a federal judge threw out the CDC’s nationwide moratorium on evictions

U.S. District Judge Dabney Friedrich said that although there was "no doubt" Congress intended to empower the CDC to combat COVID-19 through a range of measures such as quarantines, a moratorium on residential evictions was not among them. The rulingwas a setback for millions of Americans who have fallen behind on rent payments during the pandemic.

Friedrich's order gives the Justice Department four days to respond after the landlord groups' file legal papers. The White House has estimated that one in five renters were delinquent on payments by January, while the CDC has said more than 4 million adults who were behind feared imminent eviction. At least 43 states and Washington, D.C., have also temporarily halted residential or business evictions, though the protections are far from uniform.

A separate eviction and foreclosure moratorium for federally financed housing from the U.S. Department of Housing and Urban Development is due to expire on June 30.The CDC began the moratorium during Trump's presidency and it was extended three times, most recently in March under his successor Joe Biden. It covered renters who expected to earn less than $99,000 a year, or $198,000 for joint filers, or who reported no income, or received stimulus checks.

The group has estimated that 40 million Americans were behind on rent in January, with $70 billion of missed payments by the end of 2020.

A Federal Judge Remembers the Real Victims of the Pandemic: LandlordsRemember the pandemic, when for just a second it seemed as though there were orders in place to keep landlords from booting desperate people out on the street? (Of course landlords could still keep a running tally of how much to bleed out of them as soon as they were given the governmental all-clear.) Well, pandemic’s over folks, at least according to a federal judge who ruled it was never fair to mandate compassion in the first place.\n

Judge orders Justice Dept. to release Trump obstruction memoA federal judge has ordered the release of a legal memorandum the Trump-era Justice Department prepared for then-Attorney General William Barr before he announced his conclusion that President Donald Trump had not obstructed justice during the Russia investigation. The Justice Department had refused to give the March 24, 2019, memorandum to a government transparency group that requested it under the Freedom of Information Act, saying the document represented the private advice of lawyers and was produced before any formal decision had been made and was therefore exempt from disclosure under public records law.
