Prosecutors said they will present additional evidence and testimony to cement the case they built against suspended district judge Sonya McKnight.

He woke up in agonizing pain, unable to see, and soon heard McKnight asking, “Michael, what did you do?” “There’s no act alleged — just absence of the act of another,” Leshner said. “They’re seeking to hold my client responsible based on the testimony that the victim did not shoot himself.” At the preliminary hearing, McCormack said his office only put forward the bare minimum evidence and testimony required to pass the case through that hearing. The burden of proof is incredibly low at a preliminary hearing, and its purpose is to determine if a crime has been committed and if the defendant charged with the crime is most likely the person who committed it.

He told McKnight, who was sitting on the couch wearing pajamas and a pink robe, that he was going out, police said.McKnight called and texted him throughout the night. While she denied leaving the home during that time, police said Ring doorbell cameras and license plate scanners showed she drove to Crawdaddy’s — the bar where her ex-boyfriend had gone.

McCoy said he did not shoot himself and emphatically denied ever thinking about shooting or harming himself, police said.Police say, based on the appearance of the entry wound, that the gun had to be held about a foot away from the man when the shot was fired.
