Trucking company Yellow got a $700 million coronavirus loan last year by being labeled as critical to national security. A congressional panel says maybe it wasn’t.

A review by the panel suggested that Yellow provided a lower share of shipping services for the Pentagon than the agency and the Treasury had previously said, according to a report released Friday by the Congressional Oversight Commission.

A Defense Department spokeswoman said Monday that the Treasury Department made the final decision to grant such loans, adding: “The terms of Treasury’s loan program made clear that companies would only receive a loan if ‘the Secretary of the Treasury determines that the applicant business is critical to maintaining national security.’”

Yellow spokeswoman Heather Nauert said the company has a longstanding relationship with the Defense Department that includes contracts beyond the one that the commission focused on in its report. In its most recent report, the oversight panel said it had been unable to substantiate earlier statements by the Treasury and Defense departments that Yellow provides 68% of less-than-truckload services to the Pentagon, a figure it said “was used frequently to justify why Yellow was deemed critical to national security.”
