The law defines adultery as a person who "engages in sexual intercourse with another person at a time when he has a living spouse, or the other person has a living spouse.
New York is not alone in grappling with adultery laws. At least 14 other states in the U.S. still criminalize adultery, with varying degrees of severity. While some states classify adultery as a misdemeanor, three states, including Oklahoma, Michigan, and Wisconsin, consider it a felony offense.
