The fallout continues for Utah Board of Education Natalie Cline, who has apologized for making a social media post that misgendered a high school basketball pla

yer, mistakenly implying the girl was actually a boy. The girl’s family claims she received massive amounts of hate comments after this happened.

“My general view of what she said is that it’s abhorrent, and it’s protected by the First Amendment," First Amendment attorney David Reymann said.One thing that is not protected by the First Amendment is posting someone’s personal or identifying information. However, it may be hard to prove that that’s what Natalie Cline did. Reymann said if Cline simply used a picture her school had already posted, then Cline didn’t identify the girl.

“It gets difficult when you start saying a single comment can provide the basis for a claim of discrimination,” said Reymann.
