A California judge has ordered Uber and Lyft to reclassify their drivers from independent contractors to employees with benefits, a ruling that could be consequential for gig economy workers.

Schulman said Lyft and Uber use"circular reasoning" by only treating tech workers, not drivers, as employees.

"It bears emphasis that these harms are not mere abstractions; they represent real harms to real working people," Schulman wrote.

Newly classified unemployed employees.

Clearly no-one here is actually in the gig economy Waitr had drivers w2 for the longest time, offered benefits, and the pay was nice, and drivers loved it. Drivers could still pick their own hours EatStreet still has w2 drivers and they like being w2 as well

The entire gig economy is predicated on preying on the labor of a class of workers who are already overworked and underpaid in traditional jobs and therefore need supplemental income

Democrats killing one business at a time.

The government just took more of your freedom to decide how you want to work.

Stop saying “wORKerS RIghTs” if u aren’t a gig worker this is about greedy CA tax dollars most drivers like myself don’t want to unionize and if drivers quit how will that fair for the local restaurants that depend on a large group of gig workers especially during this pandemic

It will increase fares. Decrease ridership and cost jobs. Economics is like dominos push one down and others get affected.

Their entire business model is based on them being contractor's. Might as well go back to the old cab system and we can all pay double for a ride. I feel sorry for all the drivers not going to be able to pick up some side money

This ruling will drive even more business out of Cali. It also applies to truck drivers who DO NOT want to be classified as employees.

Goodbye, Uber and Lyft. The taxi lobby succeeds in killing a new and promising business model.

SoCaliSteph Nice it's about time

This is to gaurantee taxable income..right now drivers write off everything.. Give me a fucking break with this bullshit.. Cali is out of money go figure..derp

So, Uber can now fire drivers who don’t sign in, show up for work and cover surge demand?

'Do you want a job where you actually pay you employer for the right to listen to drunks? Join the Uber/Lyft team! Or... just punch yourself in the dick & bypass the hoops.'

As someone who was once wrongly classified IC re-do your taxes now to get your SE tax back!

Is this the state advocating for the insurance companies? Because drivers don’t want to be employees with the confines of a traditional job. That’s why they are drivers. I can’t think of any reason why the state would spend time and money on this.

This is awesome news!!

the min wage should be 100 dollars per hour

There’s no way this fits with the “employees” classification.

Self driving cars? Let’s goo!! lyft logangreen

Somehow don't trust California when a law is passed. Maybe this one is about illegal aliens, drivers license & companies paying benefits instead of California with tax money from citizens?

Sounds like a new movie plot description

Didn't like California pass a law for this?

I wish the do-gooders would mind their own business! Leave our jobs alone!

Kookster24 Now what?

A bit late now that nobody's using either service.

So glad to hear this. Too many companies exploit their work force by classifying them as “independent contractors.” This brings Uber & Lyft drivers one step to unionization and living wages.

Good, they’ve gotten away with essentially running sweatshops for folks in need of a steady paying job for far too long while killing the regulated taxi industry at the same time

This will be challenged in court. While I've always questioned how Lyft and Uber managed to sidestep the taxi laws, this attack on them makes no sense to me. I don't see how they get classified as 'employees.'

This will ruin millions of lives.

About time!!! Those ride sharing companies are exploitive.

Keywords 'California Judge'.

Great job. That’s the sound of thousands of people packing up and leaving the state.

Keep drivers gig workers, but pay them, not only by rides, but also the amount of time they stay clocked in and don’t get rides for. That was always my problem when I drove. Would spend 6 hours on the clock some nights and only get 5 rides...made my hourly like $5/hr, if that

That’s crazy ..

Dobnak_

I am going to go full conspiracy on this Uber vs California thing. Just remember, AutonomousVehicles do not need drivers... This is a plot for Uber and lyft to justify service levels: Driver vs FAV Service at 1/3 the price. This will not end well for the drivers. skynet

MattSpoke movesfinance

smh

What a disaster. California is dying a slow, painful death.

Uber and Lyft should be made to pay into a health insurance system for all of their employees. If that’s done, fine they don’t need to be considered full time employees.

Some smart programmers need to come up with a decentralized ride sharing system that uses crypto to pay drivers and server operators and cannot be stopped by the government.

BobbyAllyn i expect UBER and LYFT to ignore the judge's order

How can you force a company to do this

Most drivers don’t want this bullshit. This is some stupid annoying SMALL crowd of drivers Matched with white hat liberals thinking they know what’s up.I am so mad so so so mad!

Killing California economy anyway they can

FREETIANNA

Back to Mom's basement potheads!

Well there goes that business.

DiegoRuzzarin

👏🏽👏🏽

Bullshit it's to get control of the drivers income its illegal

And yet if these 'independent' contractors would file for a business , they literally could be their own boss and have their own advertising without paying more for their 'left or uber'

An accountant once told me that I would be considered an employee if I exclusively worked for my employer and he exclusively used me for that work.

RIP Lyft and Uber

Weird that when they wrote their business plans that they didn’t see this coming.

Can the judge do this

Imagine that from the fascist government of california

Let’s destroy one of the lowest barrier to entry jobs that POC can get and do as a side hustle or main income during a pandemic. What could go wrong?

So, as employees, you will have to work on a schedule instead of choosing work times.

Drivers need to start working for their interest. being independent doesn't mean not having health insurance and ruining your car to make somebody else a billionaire. it's full-time Uber switches drivers to employees with benefits.

sad.

What the Fucc...... the whole point of doing Uber and Lyft is that it’s not a committed job

A female stripper video taping me, photographing and harrassing me in Portland, OR finally made me quit. It was followed by black people getting in my car claiming to be sick while coughing. Yay. You told me to 'Have Fun!' When I complained of female harrassment.

We're proud to stand with the CA Attorney General and the City Attorneys of San Francisco and San Diego in bringing this lawsuit. Today's preliminary injunction is a resounding victory for thousands of drivers. -Mike Feuer, Los Angeles City Attorney BobbyAllyn Uber Lyft

Horse 💩 money grab government blows throughout both parties

If these companies didn’t treat their drivers so poorly they’d never be in this situation. They kept cutting pay and increasing their cut. It used to be 80% for drivers and 20% to Uber and it’s more like 75% to uber and 25% to drovers with rates down to pennies a mile SHAME!

No. Don’t want it

Now do wrestling.

I assume this ruling should apply to Amazon Flex drivers? Also classed as gig workers.

Translation: State and local .govs want their cut, and you’re their collateral.

jentaub About f*cking time.

More garbage from California to be immediately shot down by the higher court. Rinse, repeat.

chel_c_cam Cause it’s better for a job to have no workers

insurance sales agents are almost all contractors with no benefits or employee protections.

Just to be clear - it is not over until the Fat Lady Sings -the decision will go up on appeal and it could be a long time before it is the Law if the Land

Uber and Lyft waving goodbye to the California market:

So they're taxi rates now.

Wow. Wow. Wow.

Hmm. Not sure what to think.

Im gonna say this will happen in ny n nj next

A good start

Well say goodbye to Uber and Lyft California

Why would you want to be an employee? These are side hustles. I don’t want to be told when I have to work. That’s what’s great about the gig. Flexibility.

Not going to fly. The classification exists for a reason. No one is forcing them to work, and you cannot rule that independent contractor is not a legal business relationship. In other words, nice try judge.

This is the death of Lyft and Uber. I guess we will go back to the trashy system before of overpriced taxis.

Good call.
