If Roberts believes there's no difference between judges appointed by Obama or Clinton and judges appointed by Bush or Trump, he's delusional. The courts are currently more partisan than they've ever been. And it's happened on Roberts's watch.

Can Congress be a referee between the Executive and Judicial powers? Yes, if Congress writes a law that once a person is confirmed to be a judge, he/she losses the right to vote and be free from party affiliation, so, future decisions/opinions be free of political influences.

Not a secret, the decisions from the 9th circuit court are left-leaning but considering the San Fran location, it’s no surprise. Many of the 9th’s decisions have been reversed and even most Supreme Court judges feel the 9th should be split and re-proportioned.
