The Independent Office for Police Conduct says it is conducting a criminal investigation into a police officer who gave evidence during the inquest of Kelly Hartigan-Burns
The 35-year-old was known to be vulnerable with a history of mental health problems and suicide attempts but was not taken to a cell with live CCTV recording despite one being available. An inquest was held across several weeks at County Hall in Preston last year and a jury concluded that failings by Lancashire Constabulary at all stages of their dealings with Kelly contributed to her death.
One officer, former custody sergeant Jason Marsden has already been sacked by the force over his involvement. Mr Marsden attempted to appeal that decision after the inquest but a panel rejected his application after a short period of consideration. The IOPC says one of those officers, who has not been named by the force, is facing a criminal investigation over potential offences of misconduct in public office, perverting the course of justice and perjury. The IOPC says the second officer is under investigation for potential gross misconduct and is currently considered to be a witness.
