Evidence leaves judge with reasonable doubt about assailant's identity

Buckle found Lilly not guilty on all four counts, saying the Crown had not proven the identity of the man who attacked Brandon Diggs with a knife on Grafton Street at about 3:30 a.m. on July 7, 2019.Police obtained a Canada-wide warrant for Lilly’s arrest on Aug. 12, 2019, and he turned himself in a week later.The assault was captured by a video surveillance camera down the street, but the footage was of no assistance in identifying the culprit.

Lilly and 12 other men were eventually convicted in Nova Scotia Supreme Court of aggravated assault for the attack on Stephen Anderson. The Crown has applied to have Lilly undergo a dangerous-offender assessment before he’s sentenced on the aggravated assault charge. Justice Jamie Campbell heard submissions on that application last week and will give his decision Dec. 12.

Coaker was also convicted of aggravated assault in the Anderson beating and handed a four-year prison sentence for that offence. Andriko Jamal Crawley, 35, of Dartmouth pleaded guilty this July to committing an indictable assault. The Crown has asked for a jail sentence of 12 to 18 months while Crawley’s lawyer said eight to 14 months would be appropriate. Murphy will give her ruling Dec. 5.Last May, Lilly was found guilty in Supreme Court of intimidating a justice system participant. That offence was committed in March 2021 and involved a jail guard who was set to testify about the Anderson incident.
