Qantas Airways' decision not to let its stood-down workers take paid sick leave has been upheld by the Federal Court in a test case that clarifies the rights of tens of thousands of other workers across the country.

"To enable the employee to do so would go against the very object and purpose of conferring those entitlements – namely an entitlement to be relieved from the work which the employee was otherwise required to perform," he wrote in a judgment on Monday."Unfortunately, the coronavirus has meant the majority of our employees have been stood down and not receiving their regular income," the spokesman said.

Workers who are stood down on JobKeeper can be asked to take annual leave – a directive they cannot unreasonably refuse – thoughAustralian Workers Union secretary Daniel Walton said Qantas workers who needed sick and carers leave, including one with heart failure and another with a six-month-old baby and a wife who had suffered a stroke, had been "bitterly disappointed" by the decision.
