Iran ian detainee ASF17 , who has been in detention since 2013 after arriving to Australia on a boat, brought a case against the Commonwealth arguing not to be deported and remain in the country due to fears of prosecution in his home country.

Obviously, we saw the 150 that were let out after the last High Court decision and this government was warned about it as far back as June last year, had advice to do something about it, did nothing,” he said.
Through the legislation – Migration Amendment Bill 2024 - the government is seeking to impose mandatory jail sentences on non-citizens who fail to comply with orders to have them removed once all visa pathways to legally remain in Australia have been exhausted. The government has admitted ASF17’s case was one element of its urgency on the bill but has not explained what the other reasons may have been. Efforts to deport the Iranian man, however, have been ongoing since 2018, before the Albanese government came to office.
