Scott Morrison will not intervene to stop a Tamil family being deported, saying an 'exception here or there' would kick-start the people-smuggling trade.

Prime Minister Scott Morrison says he could not "in good conscience" intervene to stop a Tamil family being deported if it risked kick-starting the people-smuggling trade.

Priya and her husband Nadesalingam had been living with their daughters Kopika, 4, and Tharunicaa, 2, in Bileola until March last year when Priya's bridging visa expired. The family are currently on Christmas Island after being transferred from a Melbourne immigration centre.The family's last ditch effort to stay in Australia will be heard by the Federal Court in Melbourne on Wednesday, before an injunction blocking the government from deporting Tharunicaa expires that afternoon.

Scott Morrison told reporters he could not allow a Tamil asylum seeking family to remain in Australia."I do understand the real feeling about this and the desire for there to be an exception but I know what the consequences are of allowing those exceptions," he said. "But they didn’t come to the country in the appropriate way. They have not been found to have an asylum claim."

Home Affairs Minister Peter Dutton ruled out any intervention on Monday, saying the family's status had been assessed over many years.Following protests against the family's deportation on Sunday, Mr Dutton penned an opinion piece innewspaper, saying millions of taxpayer dollars had been spent assessing the family's case, which had proceeded all the way to the High Court.
