Irrigators in the northern Murray-Darling Basin will face tighter regulation over water they capture during floods after the upper house blocked Berejiklian government's controversial floodplain harvesting exemption.

The government had been to seeking to exempt such farms, many of them cotton, from the need to hold a water access licence or gain approvals for constructing such works.Southern irrigators had cried foul, saying that because less of the water in the north was making its way down the Darling River, they have had to make up for any shortfall, hurting their own farms.

With the disallowance motion succeeding, northern irrigators will not be able to lock in unsustainable levels of water take that would likely have to be bought back at great expense in the future by taxpayers. "NSW Water Minister Melinda Pavey now has to go back to the drawing board," Mr Field said.

An upper house Inquiry reporting this month found "significant uncertainty surrounds both the historical and contemporary regulation of floodplain harvesting"."Stakeholders such as the Environmental Defenders Office attributed this confusion, in part, to the fact that regulation of the practice spans both the Water Act 1912 and Water Management Act 2000, along with a number of water sharing plans, regulations, floodplain management plans and gazetted notices," it said.
