The former gangland lawyer has been ordered to give testimony over the phone in January, despite medical reports that say she cries most days.

Nicola Gobbo has failed in her bid to be excused from interrogation before the royal commission scrutinising her role as a double agent.The maximum penalty for failing to comply with the order to give evidence is two years in jailCommissioner Margaret McMurdo has ordered Ms Gobbo, known as Lawyer X, to give evidence over the phone next January.While the commission cannot force her to give evidence, a failure to comply with an order is a criminal offence under the Inquiries Act.

More than 10 medical reports from treating specialists dating back to 2008 have been provided to the commission.Reluctant to excuse Ms Gobbo from giving evidence, Ms McMurdo had requested more evidence she had a"reasonable excuse" to not face questioning. "So what has changed? In fact quite a lot her psychological and psychiatric state has declined," Ms Gobbo's lawyer, Rishi Nathwani, said.

Mr Nathwani argued there had been a"dramatic change" in her mental health since it was revealed she was Lawyer X and her life was placed in more danger.Mr Nathwani has been unwilling to speak in open hearings about her specific circumstances. He argued her poor concentration and memory loss would prevent her properly preparing for what could be lengthy questioning.
