Morrison government takes sick leave case to the High Court | dana_adele

The Morrison government will appeal to the High Court to overturn a landmark legal decision by the Full Federal Court which grants shift workers more sick leave.

Mr Porter said the Federal Court ruling had "created significant inequities between employees", while also exposing employers of shift workers to wage bills up to $2 billion higher each year. The Full Federal Court last month ruled that a Mondelez worker rostered on for three 12-hour shifts a week accrued 120 hours of personal leave each year, calculated as 10 days multiplied by 12 hours.

Australia Resources and Energy Group AMMA chief executive Steve Knott said the Mondelez decision was "inconsistent with not only current and longstanding industry practice, but also Parliament's intended purpose of the provisions and previous case law".

Dana_Adele I don't think it's particularly accurate to say it 'grants' shift workers 'more' sick leave. It's about the interpretation of a legislative provision, the case said that Mondelez had been incorrectly applying it
