Former homicide detective Gary Jubelin has had his sentence for illegally recording four conversations during the William Tyrrell investigation upheldJubelin, the former lead investigator in the Tyrrell case, was convicted and fined $10,000 in April afterGary Jubelin arrives at court in August.William, 3, vanished from his foster-grandmother's home at Kendall on the NSW Mid North Coast in September 2014.
Jubelin argued five grounds of appeal, including that a warrant was in place when the first three recordings were made, which meant they were authorised, and that Magistrate Ross Hudson erred in failing to give himself two directions. Judge Townsden said he does not accept on the balance of probabilities that Jubelin made the recordings to protect his lawful interest, as Jubelin had maintained throughout the court case.
While a warrant was in place for some of the recordings, Jubelin did not fill out a form listing his phone as one of the recording devices used.
gmitch_news Mixed feelings about this. Everyone's innocent until proven guilty, and the law must be upheld, but when a child killer is caught by illegal means, who'd object to that? A moral dilemma.
