Government reaches undisclosed financial settlement with Canberra teen unlawfully separated in detention

Canberra's youth justice authorities have admitted they made a mistake when they unlawfully separated a 16-year-old girl from other detainees and restricted her from items representing her Indigenous heritage.

The apology was made after the detainee filed a lawsuit alleging human rights breaches at the Bimberi Youth Justice Centre.The case had been due to be heard in the ACT Supreme Court this month, but the matter has instead been settled without the territory admitting to liability through an undisclosed financial settlement and written apology to the detainee.

The Community Services Directorate has also ordered a review of the centre's separation and personal property policies.alleging human rights breaches for wrongful segregation and restrictions on maintaining her cultural heritageThe lawsuit said the young Aboriginal woman had been in custody since March last year and permanently locked up in Bimberi since September.

In October last year, she was separated from the general population and put in the Coree Unit — used for both incoming prisoners and for the segregation or management of detainees — for almost two months.She also had a number of culturally significant personal items removed from her room, including her artwork and Koori Mail newspapers.

Court papers, filed by her lawyer Tom Taylor, alleged the teenager was told the Indigenous artwork and newspapers were removed because"they were excessive" and"undermined safety and security at Bimberi".The lawsuit asked the court to declare that her rights had been breached when she was wrongly separated from other detainees and when she was restricted from maintaining and developing her cultural heritage.
