Federal Court reveals why it backed decision to send Novak Djokovic home | SimoneFoxKoob

It was open for Immigration Minister Alex Hawke to conclude that Novak Djokovic had a well-known stance against vaccination, the three-judge bench of the Federal Court has ruled.that Mr Hawke was not able to make a finding concerning their client’s anti-vaccination stance.

“That he had a reason not to have a vaccination at the time of the decision in January 2022, apparently having contracted COVID-19 on or about 16 December 2021, did not say anything as to the position for the many months from the availability of vaccines to December 2021. “It was also open to the minister to infer that the public would view his attitude as the media had portrayed: that he was unwilling to be vaccinated.”

However, the government revoked his visa for a second time on different grounds: that his vaccine scepticism posed a risk to public health and good order of Australian society.In written submissions and in court on Sunday, Djokovic’s lawyers said there was minimal evidence to suggest the Serbian was an anti-vaxxer.
