Facebook and Microsoft have warned Australia's defamation laws pose a risk to free speech and may force platforms to censor content | MWhitbourn

, Microsoft said it received "numerous defamation concerns notices in Australia" relating to its Bing search engine and was a defendant in a string of Bing-related defamation claims. This was the case even though it was not the publisher of potentially defamatory material trawled by the search engine.

It said "unbalanced defamation law may have the practical effect of requiring a search engine operator, in response to defamation concerns notices, to block from its search results third party web page publications that are in the public interest and should be subject to defamation defences". "The effect of this can be chilling on free expression, with important web content being suppressed ... and thereby effectively rendered unfindable," Microsoft said.

Microsoft said it was "concerned that, without reform, Australia’s defamation regime may fall out of step with the laws in other nations which value and protect freedom of expression". It was "important to proceed with an appreciation of the social and economic benefits of search engine services and the contribution that this technology makes to free and open communication and access to published information".The company said it was undesirable for the reform process to be split in two and "important questions" relating to digital platforms should be considered now.

MWhitbourn Absolutely right. I can’t say what I really think of Brisbane’s Lord Mayor for fear of being sued. But he’s a political figure so all bets should be off.

MWhitbourn So, is there any politics here in Australia trying to push for a bill of rights in the constitution? I cannot imagine this country becoming a republic without a bill of rights.

MWhitbourn That is rich, coming from these guys.
