A full bench of the federal court heard from Djokovic’s lawyer Nick Wood SC and Stephen Lloyd SC who represented Immigration Minister Alex Hawke.
“It is an application to the court as a separate arm of government … to review a decision of a member of the executive, the minister, for the lawfulness or legality of the decision on the three grounds put forward,” he said. Mr Hawke argued that while the Serbian star posed a “negligible individual risk” of spreading COVID, he was still a “risk to the health of the Australian community” due to his supposed anti-vaccination beliefs.
He also claimed Mr Hawke failed to consider the likelihood that cancelling Djokovic’s visa would stir further anti-vax sentiment which made the decision “illogical”, “irrational” and “unreasonable”. These comments were made during a Facebook live event before vaccinations were readily available, with Mr Wood arguing the Minister therefore could not prove Djokovic’s current views on the COVID jab.
For the ones celebrating, remember that the minister just he was inciting insurrection without any evidence, if they do things to a high profile, guess what's going to happen to you insignificant bastards 🤔
