The Botswana government filed a mutual legal assistance request with Minister Ronald Lamola’s department of justice in September last year but is yet to receive any correspondence from the department.
The blatant refusal to assist the neighboring country’s justice efforts has resulted in AfriForum’s private prosecutions head, Advocate Gerrie Nel filing a mandamus application - to compel the justice department to offer mutual legal assistance to Botswana. The department of justice did not waste any time in issuing a warrant of arrest for Shepard and Mary Bushiri who are similarly accused of fraud and money laundering“It is extremely unfamiliar that the respondent in a court application is not sending any formal communication regarding such an important matter and would fail to make contact with the applicant’s legal representatives of record,” said Nel.
AfriForum’s head of private prosecution also accused Lamola’s department of double standards saying “the department of justice did not waste any time in issuing a warrant of arrest for Shepard and Mary Bushiri who are similarly accused of fraud and money laundering, but the department remains mum over the Motsepe-Radebe matter”.
Afriforum is clutching at straws. There's no case here.
