Advocate Busisiwe Mkhwebane's case was postponed after it emerged that Ismail Abramjee - who describes himself as a legal expert - had sent a text to advocate Andrew Breitenbach, who is representing Parliament, and stated that he had it “on very good authority that the ConCourt has declined to hear the Public Protector’s rescission application."
Mkhwebane’s counsel Dali Mpofu SC then asked the Western Cape High Court to postpone her interdict application against Parliament and the President to 18-19 May. He stated that this was because of an “unfortunate development relating to the application to the Constitutional Court brought by the Public Protector” for rescission of its judgment endorsing the legality of all but one of the rules that will govern Parliament’s inquiry into Mkhwebane’s fitness to hold office.
Abramjee had stated in his message that the Constitutional Court’s decision declining Mkhwebane’s rescission application “will be made known sometime this coming week but not later than Friday. I thought I’d just share this with you on a strictly confidential basis. Thanks.”
