He has made written representations to that effect to the JSC, which similarly received a submission from the constitutional court as the complainant in the matter. In a letter, sent shortly after the finding was released, Hlophe insisted that the tribunal failed to formulate a clear charge for him to answer, because there is no statutory enabling provision to make a contravention of section 165 of the constitution an offence.
The tribunal, in its 47-page report, dealt with and dismissed this argument, saying that because it was not a criminal trial the requirement did not apply. Rather, the tribunal was concerned with principles of judicial probity and ethical standards.which is a decision that ultimately falls to the national assembly where a vote needs to be carried by a two-thirds majority.

JSC knows it has many other corrupt Judges they don’t want to open a can of worms.
The JSC disgraced itself before in failing to act against Hlophe. It had to be taken to court to be forced to do its job properly. Judging by the casual way they deal by with this utmost serious matter , it is going to be necessary again.
Stop considering and just act FFS.
JSC is Witchhunting
The country demands action and is watching
, I hope that this is a justice not some political witchhunt for those who believed to be Zuma's supporters?
Why is it that just about every 'high level' type court case constantly gets postponed to a much later date? Why can decisions not be reached much sooner? Everything just drags on and on. Unless you some poor non connected individual. Or so it seems to me.
The JSC is slower than Home Affairs. Didn't think that was possible.
Again?
