High Court dismisses Malema's application challenging the Riotous Assemblies Act of 1

Malema was charged with violating the act on two occasions by encouraging his supporters to invade vacant land.Malema says he will now challenge the Riotous Assemblies Act at the Constitutional Court.“We will also appeal directly to the Constitutional Court because we still believe that the Riotous Assemblies Act is unconstitutional in its entirety,” Malema told reporters inside the courtroom after the judgment.

“We hope that the NPA will respect the decision of the court and wait for the confirmation of the Constitutional Court on the constitutionality of the section of the Riotous Assemblies Act.”

Yes, the section he was charged under has been declared unconstitutional by the Court. Matter has been referred to Constitutional Court for confirmation.

His legal bills keep on heaping up. What a clever way to spend his money.

Malema& EFF have no constitutional rights to use streets bull tactics against our constitutional rule of law & if the EFF is not happy with riots act Parliament is there to change that act& President will sign for a new act after Parliament committees& EFF voted for a new act!!

However the judge declared the section in which malema is charged with unconstitutional and referred it to the unconstitutional court ! Judge only dismissed that the whole act is unconstitutional but section it is ! And malema was not charged with whole act but that section

SA is a constitutional state: Malema&EFF can not bull& undermine our rule of law& every law is constitutional until the Parliament committees vote& President sign for new law into constitutional act!!!! SA is not a barbaric banana Republic were rules of law are change on street!

The verdict is not surprising, it's well known fact that Courts of Law still inherit the doctrine of the Apartheid Evil System. This is the same on how consumers cases are treated just like my case against Wesbank. S S Mapeka vs Wesbank. I am prepared to unpack my grief.

So Malema is now losing court battles like Zuma.

If some other sections of the act are found to be uncunstitutional and the matter being referred to concourt for the act to be scrutinized then the act is unconstitutional.

I’m no friend of the EFF. Many people know this. But I’m not sure how this act can be constitutional. The context of the act and how/why it came into being is off. It shouldn’t be a matter of the sections but the act in its entirety.
