De Beer Attorneys has called on small businesses who have suffered financial loss as a result of load-shedding to come forward.

The law firm is calling on small businesses and other commercial interests who have suffered financial loss as a result of the rolling blackouts to come forward.READ: Eskom CEO blames power stations not producing enough megawatts Meanwhile the power utility is expected to argue that power cuts are neither wrongful nor negligent and are a responsible response to ensure the grid does not collapse.

Constitutional Law Expert Advocate Michael Osborne says although it is not possible to sue the state for failure to supply for basic needs, there are exceptions."In the ordinary case you cannot sue the state and civil court for failure to supply your needs, there are however exceptions to that," he said.

"We now have the constitutional right to basic services, firstly and secondly, that it is possible to demonstrate that the failure to provide needs or provide for fundamental needs is due to malfeasance or corruption or gross negligence, there indeed, there is a possibility of a successful court challenge," said Osborne.

Lawsuit to a wounded Eskom

DeBeerAttorneys - greedy lawyers blinding the ignorant.

Typical greedy lawyers - law suit is for THEIR financial greed, while we have to pay more! DeBeerAttorneys should be ashamed. If we ALL sue Eskom, and get R100 from it, Eskom will charge us R100 more to cover the loss, while these filthy lawyers take 50% of it all for 'fees'!

And wheeerrreee do you think they are going to get the money from cos they are bankrupt.

These lawyers are suing a business that is in debt and on life support.🤷🏾‍♂️

This is going to be interesting but is the whole thing not about arguments and subjection and hoping that the judge is friendly to the cause ...?

A futile exercise I am sure, only because this Gov't is so corrupt, no one is answerable to wrong-doings, mismanagement, theft, state capture or any other criminal activities. I fervently hope De Beer Attorneys succeed - its time to get rid of this govt.

There is prescedent in the pothole and the fire on the side of the road two locus classicus cases all law students know, neh?

Is this a joke or are you for real admin? If it's the case we should the police commissioner the crime, I will also sue eskom for inconveniencing me on watching my favourite tv shows during load shedding.
