The Labour Appeal Court has dismissed claims that an appointment to the Department of Correctional Services was sinister.

Appellant Fred Engelbrecht, deputy regional commissioner of the Western Cape, was appealing a case dismissed on 3 March 2020. The other posts were left vacant, except for the regional commissioner of the Eastern Cape, which went to a Mr Breakfast. "Given the fact that the need arose to appoint four regional commissioners at the same time when the DCS was in a policy developmental stage concerning employment equity, this clash is a salient factor which casts a shadow over the relevant events."

Klaas went on to fill the position of the regional commissioner in the Western Cape, scuppering any hopes Engelbrecht had held.
