The bruising three-year legal battle between festival director Joe Chakela and the Limpopo department of sport, arts and culture may finally be over, but he is still waiting for payment.

This despite the Polokwane High Court ruling in July that Chakela should be paid more than R3 million in compensation within 14 days. City Press can reveal that the department only told Chakela this week that it would pay him “by the next run”.

Chakela’s nightmare started in 2016 when the department awarded his company, Magula Promotions, a R40 million tender to host its annual Mapungubwe Arts, Culture and Heritage Festival for three years. This court was taken aback when hearing from John Mokonyana, the department’s deputy director, testifying that, from time to time, the department’s officials disregard legal adviceAfter three years of slugging it out, the Polokwane High Court ruled against the department and awarded Chakela more than R3 million in damages.

According to the court documents, in 2017 the department failed to pay Magula Promotions the balance of R2.9 million after it successfully staged the province’s annual signature festival, Mapungubwe.

The department also claimed that Chakela’s bid was not responsive to the bid specifications and did not comply with provisions of its preferential procurement policy.
