Magistrate Pravina Raghoonandan found that his use of the k-word in 2016 showed ultimate disrespect, regardless of race, and could not be accepted as part of a culture.Raghoonandan acquitted Ngwenya on two counts of contravening protection orders.
In the same text message Ngwenya told Patel “you will bleed” and that Titi “will see his mother”. Titi regarded this as a threat to his life since Ngwenya knew his mother had died. Ngwenya had argued, through his legal counsel, that the k-word only became offensive when it was used by a white person to a black person.
