The court made the order on Thursday during Agrizzi's virtual appearance for fraud and corruption relating to tenders between Bosasa and the Department of Correctional Services.
The criminal matter involves four tenders valued at more than R1.8 billion. The contracts were awarded to Bosasa and its subsidiaries between August 2004 and 2007. Judge David Makhoba said the court wanted professionals to decide on Agrizzi's fitness to stand trial.He cited previous testimony by neurosurgeon Dr Herman Edeling, who told the court Agrizzi had brain damage and did not meaningfully participate in court proceedings.Makhoba cited Sections 77 and 79 of Act 51 of 1977, which empower the courts to refer mentally unfit witnesses for professional evaluation.
"Taking into account the evidence that was led during the inquiry, especially the evidence of Dr. Edeling, this court is in doubt as to whether Mr. Agrizzi will be able to follow and contribute meaningfully to his defence during the trial," Makhoba wrote in his judgment.We live in a world where facts and fiction get blurred
