The ANC dodged a bullet yesterday, when the high court in Mbombela dismissed a potentially devastating legal bid to have the party’s Mpumalanga provincial executive declared invalid, as it was allegedly the product of irregular processes.
The members also argued that a national executive committee 2015 resolution to bring the two regions of Bohlabela and Ehlanzeni into one, in line with government demarcation, was not followed. One of the applicants, Peter Nyoni, said in terms of the PEC disbandment, the judge held that the application was five years late. In terms of the amalgamation of regions, the application was three years late.
“We do not understand this reasoning so we will await the full judgment. But, on the issue of regions, the transgression is still there. Whether this happened three years ago is immaterial. If you are in possession of stolen property, it does not matter when you stole the property.”
