DURBAN - The alleged hit organiser in the Kiernan ‘AKA’ Forbes and Tebello ‘Tibz’ Motsoane murder case said the State failed to provide evidence that he followed the rapper from the airport on the day he was shot and killed.
Five of the men accused of killing AKA and Tibz returned to the Durban Magistrates Court for their high-profile murder case on Monday. The State alleges that Gwabeni was driving a grey BMW when he exited King Shaka International Airport and that he used his virtual card on the phone to pay for parking, but Gwabeni said the State has no concrete evidence of this.
His lawyer, Paul Jorgeson, read the affidavit:"Had I been the driver of the grey BMW on the day and time in question, I would have expected the State to state categorically that they have video evidence of me driving the motor vehicle and following Forbes. "The fact that they have not stated this is an indication that they have no evidence that I was driving the grey BMW or even in the said motor vehicle.""Pillay alleges that I was at the airport and that I used my phone to pay for parking using a virtual bank card. If he had investigated properly and objectively, he would have noted that my wives and those who do work for me are also in possession of a virtual bank card linked to my account.
