In 2021 alone, 70 restrictions on abortion have taken effect in 14 states in America

, giving conservatives a 6-3 majority. And on May 17th the court announced it will consider the constitutionality of a Mississippi abortion ban passed in 2018—a case that tees up, to be argued in the autumn and probably decided next spring, comes amid a torrent of state regulations to undermine access to abortion. In 2021 alone, 70 restrictions have taken effect in 14 states.

There is little hope of a repeat surprise. Mississippi’s law banning abortion before viability is, as both the district court and the highly conservative Fifth Circuit Court of Appeals saw, blatantly unconstitutional under. The question for the Supreme Court, then, is whether all pre-viability abortion bans really are unconstitutional—in other words, whether those decades-old precedents should stand. Where the public stands is tricky to divine.
