Bennett first cautioned Mann on the advantages of keeping the court-appointed attorney; Mann insisted on the change and said he had not practiced law but had been studying it. Miller testified at the grand jury proceeding that the two men had been drinking at The Spur with their girlfriends, saying that Mann left earlier than the rest to go back to their duplex in North Pole. Miller and the two women arrived at the home later, around 4 a.m., and the women went inside.

Minutes later, Mann searched Miller’s wallet and found his military identification, the charging documents say, prompting Mann to tell Miller, “They sent you as my backup.” Yff responded on Jan. 12, writing that he and his client had no intent to argue as much during trial. Yff’s response objected to only minor, semantic points, and Bennett granted the most substantive parts of the state’s motion on Jan. 24.
