If COVID-19 poses risks to elderly inmates, may a judge order their release? Trump administration lawyers say no and ask Supreme Court to intervene.

The Trump administration is asking the Supreme Court to intervene for the first time in a case related to COVID-19, to block a judge’s order that a low-security federal prison in Ohio transfer, release or send home some of its elderly and medically vulnerable inmates.

Granting the appeal would “block an order that will save lives,” said David Cole, the ACLU’s national legal director. “Around the country, courts have been slow to step in and take responsibility to protect the tens of thousands of incarcerated people who are at risk from this virus. Bold leadership from courts will be required to mitigate the humanitarian crisis we’re facing.”The Elkton Federal Correctional Institution in northeast Ohio has been hard hit by the coronavirus.

In response, U.S. District Judge James S. Gwin on April 22 ordered the prison to evaluate its prison population and identify those who were at high risk because they were 65 or older or had medical conditions like asthma or a heart ailment that put them in danger if they contracted the virus. The prison subsequently said 837 inmates were in those categories. But officials later said only five of the inmates were suitable candidates to be confined at home or released.

In the Ohio prison case, Francisco argued that the judge had overstepped his authority and evaded the Prison Litigation Reform Act of 1995, which bars inmates from challenging prison conditions in federal court until they have tried to obtain relief through the prison grievance system.

As long as they wear masks and practice social distancing while committing crimes, it’s ok!

You have to make room for the true criminals that open businesses to feed their families. Such selfishness deserves jail time. EndTheShutdown

Good! The same people who are up in arms for the rights of criminals happy to snitch on their neighbors for trying to make a living. Self righteousness is no virtue to be proud of

How did one of the great scumbags of our time, Paul Manafort, get out?

Unless they're friends of the IllegitimatePresident, of course...

The insanity of the left. Release dangerous criminals from prison. Put that hair salon owner in prison for trying to feed her family by earning an honest dollar. Arrest that mom in the park pushing her child on a swing. Release the criminals. Republicans win 2020 in a landslide

Excellent Trump's decision. Only leftists and libtards want to set free criminals. Countless of violence against residents are happening in States that have released inmates for ' humanitarian reasons. DeAnna4Congress SpeakerPelosi GavinNewsom GovWhitmer IngrahamAngle

CRIMINALS DESERVE NOTHING!

What’s wrong with democrats? Cartel funded?

Put Paul Manafort back in?

What after he had his buddies released

Best thing he has said or done in his almost 4 years.. awesome realDonaldTrump

Did they ask to bring Manafort back into prison, seeing as he didn't qualify the criteria set for covid-19 release anyway?

He sure keeps the SC busy🤨

Trump need to release Mutulu Shakur

Oh sure after he lets his friends out

It's their right .

Conveniently after Manafort and Cohen got out. This administration is just evil.

Damn straight they should.

The irony! Cult45

Why is the president of the United States obcessed with killing people?

But realDonaldTrump is cool with PaulManafort and michaelcohen getting ‘home release’. Understood.

Now that all the Trump assholes are home from prison, this makes sense.

But for Manafort, Flynn, and other White, privileged, rich prisoners, it is perfectly ok.

Just after he had his buddies released

Most of those inmates go out only to commit more crimes.

Trump has ordered all flags on government buildings lowered to half-staff through Sunday 'for every life lost to the coronavirus pandemic.' Sad when you plainly see the puppeteers' work. Trump would never have come up with that on his own. Nice of him to finally acknowledge the deaths, after months of not even bothering to express condolences to the victims' families. Tuck Frump
