BATAVIA, Ohio -
A Clermont County judge on Friday had been expected to hear arguments on Chad Doerman’s mental state, after he pleaded not guilty by reason of insanity. In Ohio, someone who is incompetent cannot face the death penalty. But, Judge Richard Ferenc determined he would wait until August to hear arguments, after both sides have had a chance to submit psychological expert reports about Doerman’s competency. That means the trial will now not happen until late summer or early fall of 2025.Doerman has been in jail since last June, when deputies responded to a 9-1-1 call from his wife, after police said he shot-to-death his 3, 4, and 7-year-old boys.
Since the trial was delayed more than a year, all of those efforts to qualify a jury were thrown out and the process will have to begin all over again, probably about a year from now. The judge in March tossed-out Doerman's confession, deciding deputies violated his rights by failing to mirandize him before interrogation and questioned him after he had asked for an attorney.“And just briefly Mr. Doerman,” said Ferenc, “I know that Mr. Meyers and Mr. Haynes have been representing you. But they discussed these matters with you in particular, the waiver of your speedy trial rights as Mr. Meyers has just stated?"“Yes your honor," said Doerman.
