Regardless of what is happening in the Senate, the Supreme Court is carrying on in its usual stately fashion. The court is an institution built on tradition, and the traditional opening day of the term is the first Monday of October.This time, however, there will be just eight justices, not the usual nine, and because of COVID-19, once again the justices will gather by telephone hookup to hear the lawyers make their arguments.
Despite that"institutionalist streak," with Ginsburg's death and her replacement by the very conservative Barrett, Roberts may well have lost his leverage, observes University of Michigan law professor Nicholas Bagley. Trump's newest supreme court nominee, Barrett, has been highly critical of Chief Justice Roberts' reasoning in the previous Obamacare cases.
There is, he adds,"an air of surreality" around the current case. Indeed, sources say that top Justice Department officials tried and failed to talk Trump out of bringing the case. "Lurking in the background is the possibility that this could become the most tumultuous and divisive term since the Supreme Court decided," says Irv Gornstein, director of the Supreme Court Institute at the Georgetown University Law Center.

Some Senator needs to ask Amy Coney Barrett about the 'prudence' part of the term jurisprudence. She clearly was willing to set aside the natural law to appease Trump's political will. Will she set aside the law of the nation in the same way?
Barrett was selected for being willing to disregard the law and provide a false legitimacy to Trump & Republicans. Abortion & healthcare are just ways to pander to their myopic base. Trump doesn’t give a damn about abortion, and only wants to kill ACA out of spite & jealousy.

If the ACA is repealed, I will die. That's a fact. I am getting medical help now that I cannot afford without it. Without that help, I will die. Repealing is murder and no one can change my mind.

Sadly, the whole notion of needing to care deeply about there being 8 justices reveals the deepest problem with SCOTUS - we all have a sense how political appoints will vote prior to cases being heard. Rs have made it another legislative chamber. Dems must re-balance the court.
They current SCOTUS is trying to undercut Obergefell
