Much of the rule breaks down different definitions for circumstances involved. Notedly, the definition of “abortion” does not include birth control or contraceptives. The list also says the termination of a pregnancy is “not an abortion” if it’s done to “save the life or preserve the health of an unborn child; remove a dead, unborn child whose death was caused by spontaneous abortion; or remove an ectopic pregnancy.

“You can't put a list out there that defines what medical judgments may or may not be with every single circumstances out there because not every circumstance is exactly the same," Zaafran said. "We were very hesitant into putting an exhaustive list out there that, in fact, would hinder the ability of specific circumstances to be looked at in a way that would be fair."

Abortion rights advocates have long called on the Texas Medical Board to create such a list of potential medical exemptions to the ban on abortions. Nearly two dozen women have sued the state of Texas over what they call a lack of clarity on medical exemptions to the ban on abortions. That case, known as Zurawski v. State of Texas, was heard by the Texas Supreme Court in November, and a decision is expected in the coming months.
