Taco Bell’s filing states that “Taco Tuesday” has become such a popular term that no business should have exclusive rights. “We reached out to his people back then,” Gregory said. “We would have been happy to sell it to him. But we never heard back.” “He told me, ‘This is a phenomenon! You have to trademark this,’” Gregory said. “I procrastinated and didn’t do it, and then one day he came in with all the paperwork, asked for a check, brought it to the patent attorney himself, and I received the service mark in 1982.”
“Rather than spend money and fight it, we amicably agreed to settle so that we have the ‘Taco Tuesday’ trademark in New Jersey, and Taco John’s has it for the rest of the country,” Gregory said. “We were fine with it.
