WASHINGTON — The Supreme Court said Monday it will decide whether existing civil rights laws ban discrimination on the basis of sexual orientation, a question that has divided the nation's lower courts.

The cases accepted Monday reflect the split among federal courts. Two appeals courts ruled that employers violated Title VII by firing gay and transgender employees. A third said civil rights laws don't cover sexual orientation. The federal Equal Employment Opportunity Commission concluded in 2015 that Title VII does protect against LGBT job discrimination. The Obama Justice Department took the same position, but under President Trump it reversed course, opposing that conclusion.

The Sixth Circuit Court of Appeals said a woman who worked for a Michigan funeral home was impermissably fired two weeks after she told her employer she was transgender. Her employer said she did not follow the dress code, but the court said transgender discrimination is prohibited by Title VII.

PeteWilliamsNBC Honestly, much as I dislike saying it, I side with the businesses here. When you take the charged LGBT aspect out, it comes down to whether or not a private business should be forced to hire someone they don’t want to and I don’t think the government should have that power (1/)

PeteWilliamsNBC I hope it includes gender identity too. Many times, employers say that they can discriminate against you for undergoing reassignment because the law doesn't cover it. Even though Title 7 really should.

Should we expand the Supreme Court?Commentators say a knockdown battle over every open Supreme Court seat is demoralizing for the country and cements the perception of the court as a political body. There have been a number of Supreme Court reform proposals discussed over the years. Merrick Garland was a true American hero and his memory will live on. The precedent was set. Presidents don’t pick a Supreme Court Justice with less than a year in office. The Dems knew they would lose so that is why they are so bitter. Have a better lead in next time & maybe you won’t get a Trump. Dem Joe Biden rule was used as precedent to not confirm Garland - if you are a Dem, and a Dem makes the rule that is abided by - doesn’t get any fairer than that!
