Alaska State Supreme Court justices heard arguments Thursday supporting and opposing a superior court judge’s ruling parts of the State’s correspondence homeschool program are unconstitutional.

Representing the State, Attorney Albert Lin says the statute allows purchases from private vendors, saying a “parent or guardian may purchase nonsectarian services and materials from a public, private, or religious organization with a student allotment.” “But if you think about Target and Amazon and Costco, those are plainly constitutional applications. I mean, that’s all this court needs to decide,” Lin said.

Before the justices, another group of defendants who used their reimbursement funds to pay for private school tuition was represented by Attorney Kirby West.“A family could say, I’m going to choose four different tutors to educate my child in four different subjects, perfectly fine, constitutionally permissible. But if those four tutors get together and say, ‘Actually, now we’re a small neighborhood school, and you can pay us all together in the form of tuition.
