Special counsel Jack Smith said Judge Aileen M. Cannon’s instructions were based on a “fundamentally flawed legal premise” and warned he may appeal her ruling.

Aileen M. Cannon is seen in July 2020 during a Senate Judiciary Committee hearing following her nomination to serve as U.S. district judge of the U.S. District Court for the Southern District of Florida. submitted their hypothetical jury instructions in the classified-document case late Tuesday, revealing sharp disagreements over how the two sides interpret the legal issues at the heart of the case against the former president and presumptive 2024 Republican nominee.in Florida.

Trump’s team said Cannon’s assignment is consistent with his position that the “prosecution is based on official acts” he took as president — not illegal retention of materials.Cannon asked the lawyers to write jury instructions about the Presidential Records Act, or PRA, which says that presidential records belong to the public and are to be turned over to the National Archives and Records Administration at the end of a presidency.
